摘要(Abstract):
劳动关系的发展困境是指在劳动关系的发展过程中,劳动关系发展的实际效果与立法者预期的目标呈现出相反的趋势。劳动关系发展困境产生的直接原因在于立法者在劳动立法制度设计时,对劳资双方交易成本设计的失衡。而劳动关系发展困境产生的根本原因在于,立法者立法理念的偏颇将对劳动者的倾斜保护与单保护相混淆。为解决当前劳动关系的发展困境,劳动立法需要,一方面,矫正当前劳动立法在劳资双方交易设计上的失衡;另一方面,针对当前劳动者与用人单位的分层趋势,区别对待分层立法,倾斜保护不同情况下的弱势一方,兼顾劳资双方的利益。
