摘要(Abstract)：
市场与政府的"双重失灵"是当前环境法调整机制面临困境的最集中体现,而"以末端应对为中心、以命令控制为中心、以制定法为中心、以利益限制为中心、以个体主义方法论为中心"的"五大思维倾向"则是其中的主要症结。从根源而言,环境问题归因于人类的"原罪","解铃还需系铃人",因此困境的解除仍需从人类自身找动力点。无疑,在民本思想指引下,唤醒民间力量,培植民间资源,是一把钥匙。民本思想的内涵可分为"民立、民意、民智、民富、民用"五个层次,它将为环境法调整机制运行中"五大思维倾向"的突破提供指引,为环境法调整机制实现多中心变革开拓路径。从而促进环境法调整机制的"从单一政府定位→多元社会选择"改良,推动"自上而下"与"自下而上"互动,实现环境治理的"从统治→治理→善治"的转型。
