摘要(Abstract):
在二手房买卖中,居间人会采取与委托人签订"禁止跳单条款"的方式防止跳单行为。最高人民法院的指导案例1号并未完全覆盖实践中可能存在的"跳单"情形,也没有为"跳单"行为的法律规制提供妥适的制度安排。因此,有必要重构居间合同规则来规制"跳单"行为,一方面应提高任意解除权损害赔偿的额度、设定任意解除权的时间限定;另一方面需要建构居间合同规则,并确立"禁止跳单条款"效力之判断标准。
