摘要(Abstract):
鸦片战争后缔结的诸多条约,将中国与西方国家以一种不同以往的形式关联起来。随之输入的新术语体系多采用古语今用、旧词新意的方法探寻中文等义词。本文以《中外旧约章大全》为文本基础,梳理、检索、整理晚清条约法律术语的对应关系,重新审视条约法律术语在特定历史条件下的汉译,从而得出结论:晚清条约法律术语存在译名混乱的现象,它是多种因素作用下的产物,并折射出西方国家对晚清社会的影响。

- 10 In June,1858,Russia,the United States,the United Kingdom and France had successively signed the Treaty of Tientsin with China.Shortly afterwards,the United States,the United Kingdom and France signed the Supplementary Treaty of Tientsin on Custom Tariffs with China.On the October 18,1860,at the culmination of the Second Opium War,the British and French troops entered the Forbidden City in Beijing.Following the decisive defeat of the Chinese,Prince Gong was compelled to sign two treaties on behalf of the Qing government with Lord Elgin and Baron Gros,who represented Britain and France respectively.Although Russia had not been a belligerent,Prince Gong also signed a treaty with Nikolay Ignalyev.The original name of the Convention of Peking was the"Sino-British Supplementary Treaty".In September,1861,the same treaties were signed by and between Germany and the Late Qing government as well.In the following thirty years,such relation out of treaties of commerce had made great development;the Late Qing government signed similar treaties and regulations of trade and commerce with Denmark,the Netherland,Spain,Belgium,Italy,Austria,Peru,Brazil,Portugal and so on.After the signing of the Convention of Peking,there had been an evolution of Self-Strengthening Movement within the Qing Empire.During the"Tongzhi Restoration",which was a certain period after 1860,the Late Qing government enjoyed a rather smooth time.However,in 1876,the Chefoo Convention was signed by Sir Thomas Wade and Li Hongzhang to resolve the Margary Affair,but the final treaty included a number of items that had no direct relation to the killing of Margary in the year earlier.In 1883,for purpose of invading Vietnam,France initiated war against the Qing Empire,which ended up with the Treaty of Tientsin,signed by Li Hongzhang and the French ambassador Jules Patenotre in 1885.
