摘要(Abstract):
我国劳资关系的现状距离和谐状态仍有一段距离,劳资纠纷及群体性事件时有发生。究其深层原因主要是由劳资双方权力长期失衡所致,劳动者在劳资关系中的弱势地位导致其基本权利屡遭受资方的侵害。从劳资主体的权力角度来看,保护劳动者权利的关键在于实现劳资双方权力的均衡。鉴于此,我们将重点着眼于:转变和更新理念,把劳资权力的均衡作为调整劳资关系的终极方向及目标;把劳动法律制度的完善作为劳资权力均衡的法律保障;提高劳动者的经济能力、组织化能力与集体谈判能力;规范雇主组织的行业自律和公平性;加强维权的行政执法和司法保障;改革工会的职能与代表权的构成机制;提升政府部门的调控效力等,真正实现对劳动者基本权利的维护,体现和谐社会应有的正义与公平。
