摘要(Abstract):
风险交流起源于20世纪80年代的美国的环境领域,后被应用于食品安全领域。食品安全风险交流可以通过对风险评估、风险管理全过程的同步公开透明,最大限度的降低公众基于对政府不信任而产生的对风险实际危害的怀疑或对政府决策没有信心等负面情绪。我国目前还没有食品安全风险交流相关的法律制度,《政府信息公开条例》的法律位阶、公开原则、公开形式尚不足以支撑风险交流的运行,风险管理部门收集风险信息难度大以及国民的科学素养与交流意识较为欠缺,导致风险交流工作很难开展。本文先从立法层面为食品安全风险交流划定框架,分别分析了食品安全风险交流的制度建设、风险管理部门风险信息收集的法律出路、政府信息公开的完善、专家责任制的设想以及公众科学素养和交流意识的培养,希望通过完善以上问题帮助我国建立食品安全风险交流的法律制度。
