内容提要 中国式现代化，民生为大。法治是中国式现代化的重要保障，民生与法治之间存在深刻的内在逻辑关联，两者都以权利为逻辑起点、以公平正义为价值导向，本质上是体用贯通的辩证统一关系。为适应新时代保障和改善民生的法治需求，推动民生法治的体系化构建，应明确提出“民生法治体系”这一统领性、标识性概念，由此形成中国特色社会主义法治体系中一个独立的分领域体系。构建中国民生法治体系，须遵循民生为大、经济发展与民生改善相统一、国家基本责任与社会力量参与相结合、基本公共服务均衡可及等重要原则。同时，应以健全人权保障法治体系、加强基本民生领域法治建设和提升社会治理法治化水平为实施路径，将民生领域各项事业都纳入法治轨道，全面推动构建完善的民生法治体系。

Abstract: Chinese modernization prioritizes people’s livelihoods, with the rule of law serving as a crucial safeguard. There is a profound intrinsic logical connection between people’s livelihoods and the rule of law. Both take ‘rights’ as their logical starting point and are guided by the value of ‘fairness and justice’, essentially representing a dialectical unity characterized by the integration of body and use. To meet the legal needs for safeguarding and improving people’s livelihood in the new era and promote the construction of the rule of law system for people’s livelihood, the ‘people’s livelihood rule of law system’ should be explicitly proposed as a leading and identifying concept. This forms an independent sub-domain system in the system of socialist rule of law with Chinese characteristics. To build the Chinese people’s livelihood rule of law system, it is necessary to follow important principles such as prioritizing people’s livelihood, unifying economic development and improvement of people’s livelihood, combining the basic responsibilities of the state with the participation of social forces, and ensuring balanced and accessible basic public services. At the same time, we should take improving the legal system of human rights protection, strengthening the construction of the rule of law in basic areas of people’s livelihood and improving the level of the rule of law in social governance as the implementation path, and bring all undertakings in the field of people’s livelihood into the rule of law track to comprehensively promote the construction of a sound rule of law system for people’s livelihood.
