内容提要 系统总结中国刑事诉讼司法解释的本土资源和实践经验，建构中国刑事诉讼司法解释方法论体系，是构建中国刑事诉讼法学自主知识体系的重大任务。对此，应全面总结司法解释的理论和实践成果，从价值目标、解释方法、评判标准等要素入手，建构起一个将各类司法解释要素合理安放、各归其位、严谨有序的刑事诉讼司法解释方法论体系。在价值目标上，坚持以公平正义为统领，整合人权保障、国家安全、程序正义、司法效率等多元价值目标，建构起内在协调、有机统一的司法解释价值目标体系。在解释方法上，坚持以良好的法律效果、政治效果、社会效果为导向，明确各类解释方法的性质、功能、地位，建构起位阶明晰、相辅相成的司法解释方法论体系。在评判标准上，坚持以合法性、融贯性、统一性、说理性、实效性为框架，明确各种评判标准的主要内涵、基本要求，建构起可检验、可操作的司法解释评判标准体系。

Abstract: Systematically summarizing the indigenous resources and practical experience of China’s criminal procedure judicial interpretations, and establishing a methodological system for judicial interpretation in Chinese criminal procedure, constitute a major task in building an independent knowledge system of Chinese criminal procedural law. In this regard, we should comprehensively summarize the theoretical and practical achievements of judicial interpretation, start from elements such as value objectives, interpretive methods, and evaluation standards, and construct a Methodological System of Judicial Interpretation in Criminal Procedure that reasonably arranges various elements of judicial interpretation, assigns them to their proper positions, and maintains a rigorous and orderly structure. In terms of value objectives, we must adhere to equity and justice as the guiding principle, integrate multiple value objectives including human rights protection, national security, procedural justice, and judicial efficiency, and construct an internally coordinated and organically unified System of Value Target for Judicial Interpretation. In terms of interpretive methods, we must adhere to the orientation of sound legal, political and social effects, clarify the nature, function, and status of various interpretive methods, and construct a well-defined and complementary Judicial Interpretation Methodological System. In terms of evaluation standards, we must adhere to the framework of legality, coherence, unity, rationality, and effectiveness, clarify the main connotations as well as basic requirements of various evaluation standards, and construct a Judicial Interpretation Evaluation Standard System that can be tested and operated.
