The concept of transitional economic law serves as a key marker in China’s independent knowledge system of economic law. It is rooted in the theoretical framework of the socialist market economy; this concept embodies both the particular characteristics and universal foundations of China’s economic law compared with other market economies. The dynamic interplay between an efficient market and an enabling government forms the core elements of transitional economic law, with each supporting and transforming the other. Correspondingly, market regulation and macroeconomic control constitute its fundamental categories, shaping the construction of the economic law knowledge system and informing the refinement of its core propositions, theoretical foundations, and normative principles. In the context of building a high-level socialist market economy, the socialist orientation of transitional economic law calls for distributive justice in the pursuit of common prosperity. At the same time, China’s developing market institutions reaffirm the enduring relevance of its original commitment to market cultivation and resistance to administrative overreach. The generative relationship among ‘new quality productive forces’, ‘new relations of production’, and ‘new economic law’ reveals the internal logic of its theoretical evolution, underscoring the need for proactive macro-level guidance by the enabling government to promote institutional reforms that optimize efficiency while minimizing systemic risk.
内容提要 “转轨经济法”是中国经济法学自主知识体系的重要标识性概念。它以社会主义市场经济为理论根基，标识着我国经济法理论相较其他市场经济国家的个性特征和共性基础。有效市场与有为政府是“转轨经济法”的核心要素，二者互为支撑、相互转化。相应地，市场规制和宏观调控构成其基本范畴，影响经济法学知识体系的建构，以及基本命题、基本理论和基本原理的提炼。在构建高水平社会主义市场经济体制的时代背景下，“转轨经济法”的社会主义立场要求通过分配正义实现共同富裕，“市场体系仍不健全，市场发育还不充分”的现实国情表明其原始教义仍具有持续的理论生命力与现实针对性。“新质生产力—新质生产关系—新质经济法”的促生关系暗含了“转轨经济法”的演进逻辑，在新质生产力发展中需强化有为政府的宏观引领，推动效率最优、风险可控的制度变革。
