内容提要 我国区域合作的持续深化及其对区域行政规则统一性的内在要求,使得行政裁量权基准的跨区域衔接成为一项现实而紧迫的任务,也构成了当前推进行政裁量权基准跨区域衔接的客观背景。行政裁量权基准跨区域衔接面临诸多亟待解决的难题,包括制定主体多元且权限模糊,规范依据复杂多样引发裁量基准冲突频发,以及衔接机制缺失使得跨区域协调不畅。为此,应以构造整体论为指导,运用系统化、协同性思维,构建契合区域一体化发展需求的新型行政裁量权基准制度。在制度设计上,要明确由高层级主体制定行政裁量权基准并厘清其职责范围,限缩制定行政裁量权基准的规范依据,建立健全跨区域衔接的工作机制。在配套与保障上,应通过统一立法为行政裁量权基准跨区域衔接提供法律依据,进一步加强区域协同立法,加强数字技术的赋能作用,为行政裁量权基准跨区域衔接提供坚实保障。

Abstract: The continuous deepening of regional cooperation in China and its inherent requirement for the unity of regional administrative rules have made the cross-regional connection of administrative discretion benchmarks a realistic and urgent task, and have also constituted the objective background for promoting the cross-regional connection of administrative discretion benchmarks. The benchmark of administrative discretion faces many problems that need to be solved urgently, including the diversification of the main body and the ambiguity of authority, the complexity diversity of normative basis leading to frequent conflicts of discretion benchmarks, and the lack of connection mechanism resulting in poor coordination between regions. Therefore, the holistic theory should be followed, and the systematization and synergy thinking should be applied to construct a new administrative discretion benchmark that meets the needs of regional integration development. In terms of system design, it is necessary to clarify the high-level formulators and their scope of responsibilities, limit the normative basis for the formulation of administrative discretion benchmarks, and establish a sound cross-regional connection mechanism. In terms of supporting measures and safeguards, it is necessary to unify legislation to provide legal basis for the cross-regional connection of administrative discretion benchmarks, to promote the process of regional coordinated legislation and to strengthen the empowering role of digital technology, which provides a solid guarantee for the cross-regional connection of administrative discretion benchmarks.
