内容提要 "减负与转型"是贯穿我国经济改革与法治发展的一条重要逻辑主线。运用经济法推进减负与转型,有助于整体经济系统的优化,实现"减负增效"和"转型升级";有助于通过经济法上的职权与职责、权利与义务的合理配置,促进主体负担的公平分配,实现市场主体与政府的"双向减负"和各自转型,从而促进经济和社会的有效发展。实践中,应改变既往对政策的过度倚重,推进"制度转型"、构建"包容性制度",实现法治框架下持久的"制度性减负"。

Abstract: "Alleviation of burdens and transformation" is an important logic thread through China's economic reform and the development of the rule of law. The promotion of alleviating burdens and transformation by the economic law contributes to the optimization of the overall economic system to achieve "alleviating burdens and raising efficiency" and "transformation and upgrading" • It is also conducive to the improvement of the fair distribution through the rational allocation of powers and responsibility, rights and obligations law, which can enforce the participants and government, and their respective transformation. In practice, we should change the excessive reliance on policies in the past, promote "institutional transformation" and construct a compatible system to achieve lasting institutional burden alleviation" under the rule of law.
