内容提要 聂树斌案再审是2016年中国司法领域最受社会关注的法治事件。第二巡回法庭在再审该案时面临一系列棘手的问题:如何确定该案的审理范围,审判适用何时的程序法律,案件是否公开开庭审理,本案是疑案还是冤案等。根据法律规定和再审程序的性质,合议庭认为聂树斌案再审中只审理本案的证据材料、不审理王书金相关供述不影响对案件作出公正裁判;基于有利于被告的原则在法律选择上适用新刑事诉讼法;根据司法解释的精神且基于聂树斌已经死亡的事实,该案再审中采取了不开庭审理的方式;聂树斌案按照疑罪处理,既符合法律规定,也比较主动、稳妥。该案再审的无罪判决得到了申诉人的认同,也得到了社会的普遍赞许。该案的无罪判决已远远超出一个普通刑事案件判决所要传达的是非、对错标准,它具有里程碑式的意义:它表明了人民法院坚持有错必纠、有冤必申的态度;它向各类、各级司法机关传递了严格司法、规范办案的要求;它全面落实了证据裁判原则;它彰显了程序公正理念。从不同的角度,我们可以读出该案的无罪判决书所传递的丰富法治信息。

Abstract: The retrial of Nie Shubin case was the most attractive legal case in the society in the field of Chinese jurisdiction of 2016. The second circuit court met a series of difficult issues during the retrial: how to confirm the hearing scope of this case, applying which procedure law in the trial, whether the case would have an open trial, the case was a doubtful case or a misjudged case, etc. According to the law and the nature of retrial procedure, the collegiate bench deemed that just adjudication of the case would not be influenced by only hearing the evidence material in the retrial of Nie Shubin case without hearing relevant statement of Wang Shujin; new Criminal Procedure Law was applied while choosing the law based on the principle in favor of the defendant; closed hearing was adopted in the retrial in accordance with the spirit of judicial interpretation and based on the fact of the death of Nie; that handling the Nie Shubin case as a doubtful case not only conformed to the law, but also was active and prudent. The retrial verdict of not guilty of the case was approved by the appellant and praised by the society. The verdict of not guilty is far more than conveying the standard of rights and wrongs by the judgment of a common criminal case, it has the landmark significance: it demonstrates the people's court's attitude that all wrongs must be corrected and all misjudged cases must be appealed; it delivers the requirement of strict jurisdiction and normatively handling cases to judicial organs of all types and at all levels; it comprehensively fulfills the principle of judging by the evidence; it manifests the idea of procedural justice. From different perspectives, we can gain the rich legal information conveyed by the case' verdict of not guilty.
