内容提要 目前正在进行的监察体制改革是我国政治体制的重大改革,旨在建立"集中统一、权威高效"的监察体制。此项改革立足于中国国情,遵循法治规律,既传承了中国古代监察治吏的传统,又借鉴了域外有益经验。改革内容具有四大特点:监察权成为与行政权和司法权并列的国家权力;监察全覆盖;监察职权扩展到职务犯罪调查和处置;领导体制以垂直为主。这对于推进国家治理现代化和法治化具有重大意义。本文秉持惩治腐败与保障人权相平衡的理念,对职务犯罪的监察调查问题,以及监察权与司法权的衔接问题表明观点。

Abstract: The ongoing reform on supervision system is one of significant reforms on political system in China, and the purpose is to establish a centralized, unified, authoritative and efficient supervision system. In consideration of China's national conditions, the reform not only inherits traditional culture of official supervision in ancient China, but also absorbs foreign experiences. The contents of reform have four characteristics: the supervision power becomes an independent state power, which is paratactic with the executive power and the judicial power; the complete supervision coverage shall be achieved; the supervision power is extended to the investigation and disposal of the duty crime; and the leadership system is mainly vertical. This will be significant for realizing the modernization of state governance and the rule of law. With the idea of balancing the value of punishing corruption and protecting human rights, this article puts forward some opinions on investigation of the supervision committee and the connection between supervision power and judicial power.
