内容提要 网络版权内容过滤技术的进步,将使得版权侵权的预防方式发生革命性变化。网络安全港规则已经成为充分利用这一技术的法律障碍。著作权法应适当修正这一规则,引导网络服务商与著作权人合作建立合理的版权内容过滤机制,自动识别和阻止用户的版权侵权行为。这将节省著作权人监督网络和发送侵权通知的成本,也降低网络服务商处理侵权通知的成本。通过设定合理的技术过滤标准,辅以配套的人工纠错机制,网络服务商能够将技术过滤的出错率控制在合理的范围内,避免对网络用户的合理使用、言论自由等造成实质性影响。

Abstract: The progress of filtration technique of cyber copyright content will revolutionarily change the prevention pattern of copyright tort. The rule of "cyber security harbor" has become a legal barrier to fully use this technique. The Copyright Law should appropriately revise this rule to guide cyber service producers and copyright owners to build reasonable filtration mechanism of copyright content which can automatically recognize and prevent users' copyright tort behaviors. This can save copyright owners' cost of supervising the network and sending tort notices and reduce cyber service producers' cost of dealing with tort notices. By setting up reasonable technique filtration standard with matching manual error-correcting mechanism, cyber service producers can control the error rate of technical filtration within a reasonable range, and avoid influencing cyber users' reasonable utilization, free speech, etc.
