内容提要 作为行政审批改革的重要举措,行政审批权力清单的推出备受瞩目。但目前,清单建构还处在初始阶段,主要依靠政策、文件,由行政手段推动。清单的制定没有明确的法律依据,缺少统一的法律标准和有效的外部监督机制。清单形式上粗糙简略,内容上多鱼目混珠,没有完全起到有效约束审批权的目的。如何清理和有效规范非行政许可审批以确保清单之外不再有变相审批权力的存在、如何对审批事项的合法性进行有效审查以阻止不合法的审查事项进入权力清单,如何激活行政审批的评价机制以顺应经济社会的发展和改革的需要及时修改、调整清单中的审批事项等等,都是行政审批权力清单建构中需要着力解决的问题。

Abstract: As a significant move in the reform of administrative examination and approval, the launch of administrative examination and approval power list has attracted tremendous attention. However, the construction of such power list, which is driven mainly by such administrative means as policies and documents, remains at its preliminary stage. The formulation of such power list lacks specific legal basis and is short of uniform legal standards and effective mechanism of external supervision. The power lists appear to be crude and simple in terms of their form, and they pass fish eyes for pearls in respect of their content, ergo they completely fail to serve the purpose of effectively restraining the power of examination and approval. How to clear and effectively standardize the non-administrative approval, so that no covert act of examination and approval authority will exist beyond the scope of such list; how to effectively review the legality of examination and approval matters, so that illegal review will be prevented from entering into the power list; and How to activate the appraisal mechanism of the administrative examination and approval as to accord with the needs of economic and social development and reform And timely modification and adjustment to the examination and approval matters in the power list, etc.
