内容提要 引渡请求国针对被请求国的要求作出量刑承诺,并保证承诺的顺利实现,是保障境外追逃顺利进行的关键性措施。反思我国量刑承诺制度,还存在以下问题:在上下级法院是监督与被监督关系的前提下,当前保障案件审理法院遵守最高人民法院作出的量刑承诺的机制并非无懈可击;在案件判决书没有明确提及最高人民法院已经作出的量刑承诺的前提下,难以保障判决书既实现量刑的充分说理,又实现量刑承诺的具体内容,并体现量刑承诺对于最终判决的直接约束力。对此可以考虑通过以下方式完善:建立法定的量刑承诺程序,将最高人民法院量刑承诺的决定权赋予一审法院,并逐级上报至最高人民法院核准,为量刑承诺的兑现奠定制度基础;在判决书中明确引用之前作出的量刑承诺,从而既实现量刑的充分说理,又体现量刑承诺对于判决的直接约束力,提升国际社会对于我国量刑承诺制度的认可与信心,从而推动境外追逃的良性循环。

Abstract: Sentencing commitment system is the lubricants in China's overseas fugitive repatriation. The requesting state make sentencing commitment as the requested of requested state and ensure the implementation of the commitment, is a key measure to prompt the overseas fugitive repatriation. China's sentencing commitment system have following problems: First, as the relationship between superior court and the lower court is supervision, it is difficult ensure the lower court complying with the Supreme Court's sentencing commitment; Second, It is difficult to realize sentencing commitment, achieve full reasoning of sentencing, and reflect the direct binding of sentencing commitment to final judgment at the same time without mentioning sentencing commitment in the final judgment. In view of these problems, we can improve the system from the following ways: first, establish complete sentencing commitment procedures, transfer the power of making sentence commitment of Supreme People's court to the court of first instance, laying the system foundation for the fulfillment of sentencing commitment; and second, make references to sentencing commitment in the verdict before, so as to implement the full reasoning of sentencing, express the direct relationship between the commitment and the final judgment, enhance the international society's recognition and confidence in China's sentencing commitment system, and promote the benign cycle of overseas Fugitive Repatriation.
