内容提要 既有的关于权利的释义都倾向于用权利的作用、效用来解释权利,它们实际上都不是对权利本体的解释。权利本体是观念形态的现象,是社会对某行为的赞同性评价意见,这是国家立法确认"某行为是权利"之本源。认识权利现象,必须注意"是"动词的三种不同用法与含义。通过对权利与行为、一般权利与特定权利、权利与利益、权利与个人意志的区别和辨析,我们才能真正认识权利本体。

Abstract: The existing interpretations of right tend to explain right with the functions and effects of right. In fact, they are not the interpretations of the ontology of right. The ontology of right is the phenomenon of ideology, and it is the sympathetic evaluation opinion of the society for certain behavior, which is the origin of the national legislation to confirm that "a certain behavior is a right". To recognize the phenomenon of rights, we must pay attention to the three different usages and meanings of the verb "be". Through the distinction and analysis of right and behavior, general right and specific right, right and interest, right and individual will, we can truly understand the ontology of right.
