RESEARCH ON ENHANCING BILATERAL INVESTMENT PROTECTION IN THE ‘BELT AND ROAD’ COUNTRIES: BASED ON THE CURRENT CHINA-SRI LANKA BIT

In the era of increasing global economic integration, bilateral investment  treaties have garnered more prominence, notably in the context of the  Belt and Road Initiative (BRI). This paper delves into the risks faced by  Chinese investors involved in BRI projects within Sri Lanka. Through  an in-depth analysis, it becomes evident that the 1986 BIT between  China and Sri Lanka falls short of providing a robust legal safeguard for  overseas Chinese investments. Furthermore, China’s transformation from  being a large capital-importing country to one with a dual identity as  both an importer and exporter of capital further stresses the importance  of a refreshed agreement. Ultimately, this paper aims to off er practical  solutions for amending the 1986 China-Sri Lanka BIT and aspires to  exert influence on the Free Trade Agreement (FTA) negotiations by  fostering a favorable environment for Chinese investors, so as to advance  sustainable economic cooperation among the countries along the ‘Belt  and Road’.


内容提要:在全球经济日益一体化的时代,尤其是在“一带一路”倡议的背景下, 双边投资条约的重要性日益凸显。本文探讨了中国投资者在斯里兰卡实施“一带一路” 项目所面临的风险。中国与斯里兰卡于 1986 年签订的《双边投资协定》缺乏保护中国 海外投资的法律框架。随着中国从资本输入大国转变为具有资本输入国和输出国双重身 份的国家,有必要考虑续签协定。因此,本文旨在完善《双边投资协定》,通过为中国 投资者营造有利环境以对自由贸易协定谈判施加积极影响,从而推进“一带一路”沿线 国家的可持续经济合作。
