Biodiversity serves as the very foundation for the survival and development of humanity. Recognizing this, China has made signifi cant eff orts to provide legal protection for biodiversity through public interest litigation. The country has actively explored legislation and practices that promote the development of public interest litigation for biodiversity protection, resulting in remarkable achievements in this fi eld. However, it must be acknowledged that public interest litigation for biodiversity protection still faces certain challenges and diffi culties, such as the narrow scope of qualifi ed plaintiff s, insufficient preventive protection, lack of adequate and continuous fi nancial support, and limitations in the determination of liabilities. Hence, while China has made significant strides in public interest litigation for biodiversity protection, there are still challenges that need to be addressed. Expanding the scope of qualifi ed plaintiff s, promoting preventive litigation, ensuring sufficient and sustainable financial support, and improving the rules for determining legal liability are crucial steps toward furthering the success of public interest litigation in biodiversity protection.
内容提要:生物多样性是人类赖以生存和发展的基础。我国努力通过公益诉讼的方 式为生物多样性保护提供司法保障,并在相关立法和实践上积极探索,推动了生物多样 性保护公益诉讼的发展,生物多样性保护工作取得了明显成效。但是,生物多样性保护 公益诉讼目前也面临一些困难和问题,如诉讼主体的范围较为狭窄、诉讼的预防性保护 功能发挥不充分、缺乏充足持续的资金支持、责任承担的判定存在局限性等。因此,要 实现生物多样性保护公益诉讼的优化,应进一步扩大诉讼的主体资格范围,采取一些有 效的措施来促进预防性诉讼,多途径解决诉讼资金短缺问题,完善法律责任承担判定的 规则。
