内容提要 社会公权力乃公共权力之分支, 与国家公权力相对应;其发端于社会内部治理, 是社会自治权的表征。政社分开与促进社会组织建设是国家对公共治理提出的新命题, 在国家与社会二元界分、政府与社会合作治理的新时代, 社会公权力已然以一种新的权力形态凸显于政治舞台。该权力的运行与组织建构等均与国家公权力有着迥然不同的规则抑或规律;在自治与规制的良性和谐之间, 在权力与权利的有效互动之中, 社会公权力与国家公权力一道演绎着多元民主与共建共治的新篇章。

Abstract: Social public power is the branch of public power, which is corresponding with the national public power; it stems from the inner administration of social society and represents the right of autonomy. Separating the government administration from the society and promoting the construction of social organization are the new propositions suggested by the government on the public administration. In this special time that the country has been divided into political state and civil society and the public social power and public national power have jointly made great efforts to get better administration, the social public power plays an important role in our country as a new power. The operation and organizational construction of this power have different rules with the national public power. In the positive harmony between the autonomy and regulation and the effective interaction between the power and rights and interests, the social public power and the national public power jointly play a significant role in establishing pluralistic democracy and achieving a great cooperation governance model.
