内容提要 本文以法文化的视野和法哲学的方法，重新审视和揭示了传统中国法的精 神，进而探讨它的哲学及其意义等相关问题。认为传统中国法的精神是道德人文，亦即在 人为称首的思想指导下，以仁义为内核的重生与讲礼的对立统一。在有机宇宙观下，重生 与讲礼对立统一的理想是和谐、合理、公平。如果与近代西方法相比较，传统中国法的道德 人文精神存在着宗法血缘和专制等级的缺失，但更有超越宗法血缘和追求合理秩序的普适 性，因此并不违背人类法律的内在使命和基本价值; 而且这个精神扎根于万物有序与生生 不息的自然之理，是中国人固有的世界观及其正当性所在，亦是中华文明历五千年风雨而 绵延不绝的思想根源，甚至还有可能是我们创新中国法文化的思想资源和精神动力。

Abstract: On the basis of the view of legal culture and the method of legal philosophy， this article reviews and reveals the spirit of traditional Chinese law，and further discusses certain issues concerning its philosophy and significance． This article believes that the spirit of traditional Chinese law is human-based morality，which is the unity of opposites between rebirth and ritual with kindheartedness and justice under the guidance that the human is the most important． Under the view of organic universe，the ideal of unifying the opposites between rebirth and ritual is harmony，rational and justice． Compared to the modern western law，although the moral and humanistic spirit of traditional Chinese law lack the blood relationship of patriarchal clan system and absolute level，this spirit has not violated the inherent mission and basic value due to its universality of exceeding the blood relationship of patriarchal clan system and pursuing reasonable order． In addition，this spirit comes from a nature that all things have taken place in order and lived and grown in nature，and this is not only the reason why the inherent world outlook of Chinese people is correct and the ideological roots of China’s civilization with five thousand years history，but also the thinking resources and intellectual impetus of innovating the culture of Chinese law．
