内容提要 审判管理作为目前在全国法院系统广泛推行的一种主流管理手段和方法， 已历经多元化的司法改革探索实践十几年时间，无论是审判管理体制构建还是审判管理运 行模式方法都有较多的实践经验和理论创新成果。但迄今为止，关于审判管理系统化理论 体系的法理学构架还没有完全形成，整个审判管理运行模式仍然处于改革探索实践阶段。 科学的审判管理理论体系架构和审判管理模式创新是人民法院实现司法治理理论体系和 治理能力现代化的基础。本文基于法社会学、法理学与法哲学的三维视角，立足中基层法 院审判管理工作的改革实践和理论创新经验，试图初步构建现代审判管理理论体系的法理 架构，进而探究审判管理体制机制创新的思维路径与方法。

Abstract: As a kind of mainstream measure and method spread widely by the judicial system all over the country currently，the judicial management has gone through the exploration and practice of pluralistic judicial reform more than ten years，so both institutional mechanism and operational mode of judicial management have much practical experience and theory innovation． But by far the jurisprudence framework of the theory system in judicial management has not shaped completely and the whole operational mode of judicial management is still in the period of reforming and exploring． The scientific theory framework and model innovation of judicial management are the basis for people’s court to realize the modernization of judicial management theory system and management ability． On the basis of three-dimensional perspective，which includes the legal sociology，the jurisprudence and the legal philosophy，and standing on the reform practice and theory innovation experience from the judicial management of appeal and basic courts，this article tries to preliminarily build the jurisprudence framework of modern judicial management theory system，and then further explore the thinking way of judicial management model innovation．
