内容提要 近年来审判管理一定程度加剧了审级关系的行政化和法院内部层级管理 的行政化。以院长、庭长监督指导个案审判为核心的内在审判管理制度，存在院长、庭长审 判管理依据不足、职责不明、权责不清的困境。以案件质效评估为核心的外在审判管理制 度，存在重共性轻差异、重定量轻定性、重整体轻个案等问题。院长、庭长审判管理制度转 型应以确立审判责任制为核心，构建合议庭责任制和院长、庭长审判管理责任制，做到权利 与义务对等，权力与责任统一。合理推进案件质效评估，应坚持定量与定性相结合的评估 方法，更加关注过程评价和外部参与，去除案件质效评估的行政化色彩。

Abstract: In recent years，trial management exacerbated the administration of the triallevel relationship and the internal management in the court to a certain extent． The internal trial management system that included supervision and guidance of the President to case trial had some problems that trial management responsibility is unknown and unclear． The evaluation of quality and efficiency of the case as the core of the external trial management system paid more attention to common character than differences，more attention to quantity than quality，and more attention to entirety than every case． The internal trial management system should be established in the trial responsibility and build collegiate bench accountability and President in court and case trial management accountability，so that the rights and obligations are equal and the powers are in accordance with responsibilities． The reform of the evaluation of the quality and efficiency of the case should combine quantitative method with qualitative method and lay emphasis on the evaluation of process and external participation to remove the administration of the evaluation of quality and efficiency of the case．
