内容提要 “五四宪法”作为新中国第一部宪法，奠定了新中国基本政治和法律制度 体系，为国家治理体系的建构发挥了重要作用。在 60 年的中国社会发展进程中，宪法以其 特殊的功能维护政治共同体的价值共识，提供合理平衡国家、社会与公民之间关系的平台。 同时，“五四宪法”所遭遇的历史命运为我们思考宪法与国家关系留下了深刻教训。回顾 这段宪法历史，有助于我们认识宪法对国家治理所起到的价值引导、维护共识与保障自由 的作用，进一步完善宪法保障机制与程序。

Abstract: As the first constitution of the PＲC，the 1954 Constitution laid the foundation and provided the institutional system for the constitutionalism in the PＲC，and played a significant role in national governance and construction of fundamental system． In the past 60 years，along with the development of Chinese society，the constitution safeguarded common value of the political community and provided a platform for a reasonable balance between nation，society and citizen through its special function． Meanwhile，the historical destiny of the 1954 Constitution left lessons for the relationship between constitution and nation． It will help us to further know the functions of the constitution on national governance，such as the value guidance，consensus maintenance and freedom safeguard，and further improve the mechanism and procedure of constitutional guarantee．
