内容提要 近年来，维护“大义灭亲”的官方话语与主张“亲亲相隐”的民间话语之间 进行着激烈的博弈，在这一博弈的过程中，亲属豁免的权利诉求正在生长。亲属豁免权的 立法首先在刑事诉讼的作证领域开启，但由于部门利益之间的博弈，该制度的立法初衷没 能实现。传统文化的复兴为“亲亲相隐”的回归提供了合理性和动力之源，但来自传统的 思维方式又为真正的亲属作证豁免权设置了种种障碍。来自文化的正负力量的博弈，使该 权利具有了中国独有的面相。应该理性地看待亲属豁免权的中国面相。该立法在中国应 该走一条循序渐进、有限推进、不断完善、成熟推广的路径。

Abstract: In recent years，the official discourse of“Placing Ｒighteousness above Family Loyalty”and the folk discourse of “Kin Concealment System”conflicts each other． In the course of conflicting，the claims to enough the rights of kin immunity are growing． The legislation about these rights has been firstly carried out in the field of testify in criminal litigation． However，due to the interest conflict between different sections，the legislative intention of this system has not been achieved． The revival of traditional culture provides the source of power for “Kin Concealment System”，but traditional way of thinking has brought certain obstacles for the rights of kin immunity． We should rationally treat the rights of kin immunity，and the legislation in China should take a gradual path．
