内容提要 在知识产权学科领域里，关于知识产权客体的本质性问题至今仍莫衷一 是。基于智力成果的“物”性认知，智力成果从“质”与“构”两个纬度看具有“物”的本质。 由有体物、无体物、无形物及拟制物的质构分析看，知识产权的客体———智力成果———作为 无体物具有特殊物性。根据这一特殊物性，智力成果在所有性、担保性、用益性、占有性四 个方面具有物权性特征。这一新的知识产权客体认识观不仅有助于学界进一步厘清知识 产权客体的本质性特征与财产权制度的内在规律，而且有利于学界形成更加系统、周严的 知识产权学理体系。

Abstract: In the field of intellectual property right，there is still no consensus concerning the problem about the essence of the object of intellectual property right． Based on the“material”property cognition of intellectual property，intellectual property possesses the “material”essence from two perspectives of “quality”and “formation”． Based on the analysis of the quality and formation of res corporales，res incorporales，intangible thing and drawn-up thing，the object of intellectual property right，intellectual property，has special “material”property as res incorporales． According to this special “material”property， intellectual property possesses real right character in terms of ownership character，guarantee character，usufruct character and possession character． This new understanding of the object of intellectual property right is not only conducive to further clarify the essential feature of the object of intellectual property right and the inherent law of the system of property right for the academic field，but also helpful for the academic field to establish more systematic and precise theory of intellectual property right．
