Abstract: The promulgation of the Civil Code marks the arrival of the code era in China, which provides a new value scale and historical opportunity for the construction of law-based government in the new era. The rights-based concept contained in the Civil Code and the newly established public and private law norms have put forward transformation requirements for the construction of law-based government. In order to respond to this transformation requirement, we should grasp the transformation method of constructing law-based government in the civil code era from the perception, rule and model, which will help to realize the leap from old theories to new theories about the construction of law-based government. Specifically, in terms of perception, the passive limited government should be carried forward and abandoned, and the action boundary of the active government should be clarified, so as to realize the dual construction of limited and active government; in terms of the rule, the limitations of administration according to the administrative law should be overcome, and the Civil Code should be responded to actively and incorporated into the scope of the legal basis of administration according to the law; in terms of the model, it should be oriented to specific administrative tasks, and the government should be given the right to choose public or private law subjects and behavior patterns in the non-orderly administration field.
