内容提要 中国知识产权制度现代化建设，存在着“非均衡性发展”“跨越式转型”“超大型崛起”的问题导向。围绕着什么是本土现代化的知识产权制度、知识产权制度现代化发展与国家现代化建设有什么关系、如何实现知识产权制度现代化的价值目标等重大问题，习近平法治思想和新发展理念提供了重要的理论基石和实践导向。改革开放以来，中国知识产权制度实践展现了“中国式现代化”的法治经验和发展理念：坚持知识产权制度创新与知识创新；塑造知识产权治理主体与创新主体；构建知识产权法律规范和公共政策；推行知识产权法治机制和发展机制。以制度创新推动知识创新、以法治建设保障创新发展，走出了一条中国特色知识产权事业发展之路。在全面建设社会主义现代化国家、实现中华民族伟大复兴的新征程，我们应深刻把握知识产权制度现代化的新目标新任务新要求：建设知识产权强国（目标向度），完善知识产权制度体系（现代法度），深度参与知识产权全球治理（世界维度），不断拓展知识产权现代化治理和现代化发展的中国道路。

Abstract: In the modernization of China’s intellectual property system, there is the problem orientation of 'unbalanced development’, 'leapfrog transformation’and 'super-large rise’. Xi Jinping Thought on the rule of law and the new development concept provide the important theoretical foundation and practical guidance for major issues such as what is the local modernized intellectual property system, what is the relationship between the modernization of the intellectual property system and the national modernization, and how to realize the value goal of the modernization of intellectual property system. Since the reform and opening-up, the practice of China’s intellectual property system has demonstrated the rule of law experience and development concept of 'Chinese modernization’：Adhering to the innovation in the intellectual property system and the innovation in knowledge; Shaping the main body of intellectual property governance and the main body of innovation; Establishing legal norms and public policies for intellectual property; Promoting the rule of law mechanism and development mechanism for intellectual property. A path of intellectual property development with Chinese characteristics has been formed by promoting knowledge innovation with institutional innovation and guaranteeing innovative development with the construction of the rule of law. On the new journey of comprehensively building a modem socialist country and realizing the great rejuvenation of the Chinese nation, we should deeply grasp the new goals, new tasks and new requirements of the modernization of the intellectual property system: Building an intellectual property power (target dimension), improving the intellectual property system (modem legal dimension), deeply participating in the global governance of intellectual property (world dimension), and continuously expanding the Chinese path of modem governance and development of the intellectual property.
