内容提要 互联网法院是我国原创性概念，是世界司法史上信息化背景下具有时代意义的创举，是人类法治文明的最新组成部分。它开辟了司法的新境界，在司法制度、司法原则、诉讼程序、法庭形态、审理模式、裁判规则等方面，有一系列适应互联网时代特点的重大创新，不能简单以具有工业文明特征、物理空间特点的传统司法理论为窠臼评判是与非。应当将“双线诉讼”模式与“单线诉讼”模式相区别，秉持“调适论”理念，使互联网法院的“双线诉讼”模式符合直接审理、亲历性、言词辩论等原则的内在实质要求和互联网纠纷审判规律。建议系统推进互联网法院“三步走”发展战略，进一步完善制度设计：总结改革经验，把握其基本规律；依法授权试点，确保改革于法有据；健全体制体系，实现互联网法院高质量发展，为世界贡献未来司法模式的中国智慧、中国方案。

Abstract: The Internet court is an original concept of China, an initiative with era significance under the background of informatization in the history of human justice, and the latest part of the civilization of human rule of law. It has opened up new frontiers of justice with a series of major innovations that adapt to the characteristics of the Internet era in the judicial system, judicial principles, litigation procedures, court forms, trial models and adjudication rules, which cannot be judged easily by traditional judicial theory with the characteristics of industrial civilization and physical space. We should distinguish the ‘two-line litigation’ model from the ‘single-line litigation’ model, uphold the concept of ‘adjustment theory’, and make the ‘two-line litigation’ model of the Internet court meet the inherent substantive requirements of the principles of direct trial, personal experience, and verbal debate, and the rules for adjudication of Internet disputes. It is recommended to systematically promote the ‘three-step’ development strategy of Internet courts, and further improve the institutional design. We should summarize reform experience and grasp fundamental rules, authorize pilot projects in accordance with the law to ensure that the reform is based on law, and improve the institutional system to achieve high-quality development of Internet courts, contributing Chinese wisdom and Chinese solutions to the future judicial model of the world.
