内容提要 中国环境司法守正创新，须归纳其表层现象、挖掘深层逻辑。作为中国环境法治异常活跃的板块，中国环境司法显现出审前有限能动、审理适度能动和审后积极能动的能动现象；同时它镶嵌在具有中国特色的政法体制中，又呈现出政治引领、行政观照和法院主导的程度各异的协同现象。两大样态共同存在于环境司法专门化体系之中。中国环境司法能动协同现象形成于中国特色的党政逻辑，发展于中国社会的改革逻辑。其中，党政逻辑包括党对政法工作绝对领导的理论逻辑、政法体制执行党的意志的历史逻辑和环境司法体现党政体制创新的实践逻辑；改革逻辑包括增进公益福祉要求环境司法能动协同的社会逻辑、优化制度安排支撑环境司法能动协同的制度逻辑以及促生软硬合力增进环境司法能动协同的文化逻辑。

Abstract: China’s environmental justice upholds fundamental principles and breaks new ground, whose surface phenomena should be summarized and the deep logic should be explored. As an extremely active sector of the environmental rule of law in China, China’s environmental justice shows the dynamic phenomenon of limited pretrial activity, moderate trial activity and post-trial active activity; At the same time, it is embedded in the political and legal system with Chinese characteristics, and presents a synergistic phenomenon of different degrees of political guidance, administrative observation and court leadership, and the two major forms coexist in the specialized system of environmental justice. The dynamic synergistic phenomenon of environmental justice in China is formed from the logic of Party and government with Chinese characteristics, and has developed in the reform logic of Chinese society. The logic of Party and government includes the theoretical logic of the Party’s absolute leadership over the political and legal work, the historical logic of the implementation of the Party’s will by the political and legal system, and the practical logic of environmental justice reflecting the innovation of Party and government system; and the reform logic includes the social logic of improving public welfare to require the dynamic synergy of environmental justice, the institutional logic of optimizing institutional arrangements to support the dynamic synergy of environmental justice, and the cultural logic of promoting soft and hard forces to enhance the dynamic synergy of environmental justice.
