内容提要 伴随科技发展，数字时代虚拟货币类物拓展了涉案财物的形态。以比特币为典型的虚拟货币属于新型涉案虚拟财产。我国刑事司法实践中强制处分虚拟财产存在困境，包括本体手段界定不清、实践运用欠规范，强制处分探索中四种不同模式均有局限，强制处分后的延续性状态和效力无法确保。对于新型虚拟财产的强制处分，传统法律治理理论适配性较弱，相应理论供给也不足，故技术性正当程序与过程性监督融合论应被提倡。未来，刑事涉案虚拟财产强制处分应走向新型技术性过程监督下的综合模式。

Abstract: With the development of science and technology, the virtual currency in the digital era has expanded the form of property involved in cases. The virtual currency, taking Bitcoin as a typical example, is a new type of virtual property involved in cases. In China's criminal justice practice, there are difficulties in the compulsory disposal of virtual property, including the unclear definition of the ontological means, the nonstandard practical application, the limitations in the four different modes of compulsory disposal exploration, and the uncertainty of the continuity and effectiveness after compulsory disposal. For the compulsory disposal of new virtual property, the adaptability of traditional legal governance theory is relatively weak, and the corresponding theoretical supply is also insufficient. Therefore, the integration of technical due process and procedural supervision should be advocated. In the future, the compulsory disposal of virtual property involved in criminal cases should move towards a comprehensive mode under the supervision of new technical processes.
