内容提要 中国《民法典》设置独立的人格权编，是新时代下基于满足人民群众日益增长的美好生活需要所作出的重大创新，是《民法典》中国特色、实践特色、时代特色的集中体现，对构建中国民法学的自主知识体系具有标志性意义。人格权编的体系价值在于，以“编”这一具有最大包容度的框架为人格权未来的发展提供充分的空间。通过内部体系与外部体系的创新，人格权编构建起了中国范式的人格权保护体系。通过对人格尊严、人格平等、人格自由发展和人格权利保护的全面立法肯认，以及在新的社会经济条件下针对科技革新挑战的法律回应，人格权编有效地应对了主体客体化的风险，抵御了一切物化人的企图，展现了中国在新时代坚持全面推进依法治国、在法治轨道上全面建设社会主义现代化国家的全新探索，为中国式现代化的实现提供了有力保障，并为世界法律发展贡献了“中国智慧”。

Abstract: The independent Book of Personality Rights in the Chinese Civil Code represents a significant innovation in the new era for the purpose to meet people’s needs for a better life; it typically reflects the Chinese character, the practical character and the contemporary character of the Civil Code, and symbolizes a meaningful step of the construction of the autonomous knowledge system of Chinese civil law. The value of the Book of Personality Rights is to provide adequate room for the future development of personality rights within the framework of the Code. The Book of Personality Rights has different functions from the regime of civil subjects and from tort law and realizes meaningful innovation both in the inner and external system of the Code. The establishment of the Book of Personality Rights constitutes the legal response to the challenges posed by scientific innovations under modern socio-economic conditions, and it aims to resist the risk of the ‘objectivation of the subject’ and the reification of human beings. This Book reveals the Chinese efforts to comprehensively advance law-based governance and to construct a modern socialist country in all respects under the rule of law in the new era, which may be considered the ‘Chinese wisdom’ or ‘Chinese paradigm’ to the development of the law from the point of view of legal civilization.
