内容提要 作为当代中国马克思主义法治理论、21 世纪马克思主义法治理论，习近平 法治思想蕴含着改革创新的时代精神。习近平法治思想孕育于深厚的时代背景，是改革开放 尤其是党的十八大以来全面依法治国实践经验的科学总结和理论升华；习近平法治思想蕴 涵着党的领导这一时代之魂，始终坚持以党法关系为法治中国的根本关切，科学揭示了法治 逻辑与政治逻辑的价值同源性和规范统一性；习近平法治思想紧扣时代主题，围绕中国特色 社会主义建设这一中心线索，在理论定位上牢牢把握中国特色社会主义事业发展的总依据、 总布局和总任务；习近平法治思想发出了法治中国的时代之问，深刻地回答了法治的初心使 命、治理模式与外部环境等一系列具有根本性、全局性和长远性的关键问题；习近平法治思 想凝聚着鲜明的时代价值，彰显了人民主体的权利精神、尊重规律的科学精神、和谐包容的 人文精神、社会公平的法理精神。

Abstract: As the Marxist thought on the rule of law in contemporary China and the Marxist thought on the rule of law in the 21st Century, Xi Jinping Thought on the Rule of Law contains the times’ spirit of reform and innovation. Xi Jinping Thought on the Rule of Law is rooted in a profound background of the times, and is the scientific summary and theoretical sublimation of the practical experience of the comprehensive law-based governance of China since the reform and opening-up, especially since the 18th CPC National Congress; Xi Jinping Thought on the Rule of Law contains the Party’s leadership as the soul of the times, and always adheres to the relationship between the Party and law as the fundamental concern of China under the rule of law, and scientifically reveals the value homology and normative unity of the rule of law logic and political logic; Xi Jinping Thought on the Rule of Law is closely related to the theme of the times, and around the central clue of socialist construction with Chinese characteristics, it firmly grasps the general basis, general layout and general task of the development of the cause of socialism with Chinese characteristics in the theoretical orientation; Xi Jinping Thought on the Rule of Law sends out the question of the times of the rule of law in China, and deeply answers a series of key questions with fundamental, overall and long-term significance, such as the original aspiration and mission of the rule of law, the mode of governance and the external environment; Xi Jinping Thought on the Rule of Law embodies the distinctive values of the times and shows the spirit of rights with the people as the main body, the scientific spirit of respecting the rules, the humanistic spirit in harmony and tolerance, and the legal spirit of social equity.
