内容提要 社会规范是指由社会自身产生的以及由各类社会组织制定的规范类型所形 成的体系性组合或集合，包括习惯规范、道德规范、宗教规范、社会组织自制规范和各级政治 权威机关制定的专门用于管理内部成员的自制规章。从理论和实践上来讲，将社会规范纳 入备案和审查范围是必须的，一方面能够发挥社会规范在协调社会关系、约束社会行为、维 护社会秩序等方面的积极作用，另一方面能够防止社会规范偏离正轨而产生的负面作用，进 而实现国家和社会生活的法治化。同时，将所有社会规范纳入备案和审查范围也是可能和 可行的，关键在于建立分种类、多层级的备案审查制度，采取内部审查和外部审查相结合的 方式，将不同的社会规范纳入不同的组织体系和层级体系，并根据需要进行事先审查、事中 审查或事后审查。

Abstract: Social norms refer to the systematic combination or collection produced by society itself and formed by the types of norms formulated by various social organizations, including customary norms, moral norms, religious norms, self-made norms of social organizations and self-made regulations formulated by political authorities at all levels specifically for the management of internal members. Theoretically and practically, it is necessary to include social norms in the scope of filing and review. On the one hand, it can play the positive role of social norms in coordinating social relations, restricting social behavior and maintaining social order; on the other hand, it can prevent the negative effects caused by social norms’ deviation from the right path, and thus realize the rule of law in the country and social life. At the same time, it is also possible and feasible to include all social norms in the scope of filing and review, and the key is to establish a filing and review system by category and hierarchy, adopt the combination of internal and external reviews, incorporate different social norms into different organizational systems and hierarchical systems, and conduct prior, interim or ex-post reviews as needed.
