内容提要 科研项目经费管理体制机制改革是深化科技领域“放管服”改革的核心之 举。当前，我国科研项目经费管理存在组织机制不科学、运行机制不顺畅等问题，严重阻碍了 经费治理能力与治理水平现代化进程的稳步推进。科研项目经费管理体制机制改革法治化 的本质在于尊重科学契约关系的基础上，实现国家与科学在科研项目经费管理中权力（利）、 义务和责任配置的规范化。需实现科研项目经费管理改革法治化，以优化科研项目经费管 理的权力配置为基础，以增强科研项目经费管理的权利保障为目标，以实现科研项目经费管 理的责效兼容为保障，探索出既符合公共财政管理的基本要求又契合科研活动基本规律的 科研项目经费管理法治化道路，助力创新型国家建设。

Abstract: The reform of the scientific research project funds management system and mechanism is the core move to deepen the reform of‘delegate power, streamline administration and optimize government services’in the field of science and technology. At present, the funds management of scientific research projects in China faces many problems such as unscientific organizational mechanisms and unsmooth operating mechanisms which have severely hindered the steady progress of the modernization process of funds governance capabilities and governance levels. The essence of the legalization of the scientific research project funds management system and mechanism is the normalization of the allocation of power (right), obligation and responsibility between the state and science in the management of scientific research project funds based on the respect for scientific contractual relation. It is necessary to realize the legalization of scientific research project funds management reform, based on the optimization of the power allocation of scientific research project funds management, to enhance the protection of the right of scientific research project funds management, taking the compatibility of responsibilities and effects as the guarantee, so as to explore the legalization path of scientific research project funds management that not only meets the basic requirements of public financial management, but also meets the basic rules of scientific research activities, and helps to build an innovative country.
