内容提要 中国古代逐渐确立了律典简约化的理念与条例成文化的技术，并在此基础 上实行律例统编，形成了“律为正文，例为附注”的兼具稳定性与灵活性的法律体系。中国 近代在移植大陆法系国家民法制度的过程中，经过二十余年的探索建立了简约化的民法典 与判例要旨共构的民法体系。中国古代与近代律例统编的经验教训，对我国当代建构稳定 性与灵活性兼备的民法体系，完善指导性案例制度不无借鉴意义。为了更好发挥指导性案 例的作用，在简约化民法典的体系下，我国民事指导性案例应当成文化，与民法典统编；同时 创建指导性案例的整理与变更制度，完善“民法典为纲，指导性案例为目”的民法体系。

Abstract: In ancient China, the concept of code simplification of laws and the technique of regulation codification were gradually established, and on this basis the unified compilation of laws and regulations was implemented, forming a stable and flexible legal system featuring ‘laws as the text and exemplar cases as the supplementing notes’. In the process of transplanting civil law systems of continental law countries in modern China, after more than 20 years of exploration, a distinctive civil law system with the co-construction of the simplified Civil Code and the gist of precedents was established. The experience and lessons of the unified compilation of ancient and modern laws in China are of great significance to the construction of a stable and flexible civil law system and the improvement of the guiding case system in contemporary China. In order to give a better play of the role of guiding cases, under the simplified legal code system, China’s civil guiding cases should be codified and uniformly compiled with the Civil Code. Meanwhile, a working mechanism of sorting and revising guiding cases should be established, in a bid to improve the civil law system with‘the civil code as the main body and guiding cases as supporting tools’.
