内容提要 《民法典》侵权责任编承继了《侵权责任法》部分条文，也有不少修改，增加 了较多新条文并删除一些条文，在立法结构和体系上有所调整。侵权责任编的主要创新在于： 贯彻社会主义核心价值观，提供更明确的行为规范，夯实侵权责任的公平正义基础，更精准保 护和救济民事权益与保障行为自由；贯彻生态文明理念和“绿色原则”，规定更为严格的环境 污染和生态破坏侵权责任制度；完善网络侵权责任制度；吸收司法实践和法学研究成果，完善 了侵权责任的若干具体制度和规范。正确理解和实施侵权责任编，要把理论研究和司法实践 统一到新的法律规定上来，要充分发挥体系解释等法学方法的积极作用，清理旧的司法解释、 制定新的司法解释和颁布相关指导案例。侵权责任编将接受法治实践的检验并不断完善发展。

Abstract: The Part of Tort Liability in the Civil Code inherits some provisions of the Tort Liability Law, and there are also many amendments. It adds many new provisions and deletes some, and makes some adjustments in the legislative structure and system. The main innovation of the Part of Tort Liability lies in: implementing the core values of socialism, providing more explicit norms of conduct, consolidating the fairness and justice foundation of tort liability, and more precisely protecting and relieving civil rights and interests and guaranteeing the freedom of conduct; implementing the concept of ecological civilization and the green principle, stipulating a stricter tort liability system on environmental pollution and ecological damage; improving the network tort liability system; absorbing the achievements of judicial practice and legal research, and improving several specific systems and norms of tort liability. To correctly understand and implement the Part of Tort Liability, it is necessary to unify the theoretical research and judicial practice into the new legal stipulations, give full play to the positive role of legal methods such as system interpretation, clean up the old judicial interpretations, formulate new judicial interpretations, and promulgate relevant guiding cases. The Part of Tort Liability will accept the test of the rule of law practice and continue to be improved and developed.
