内容提要 商法思维的逻辑结构是由商法理念、价值与原则，商法思维模式，司法三段 论和商法解释方法组成的一个严密体系。商法理念、价值与原则是商法思维的逻辑内核与 逻辑起点；思维模式是商法思维的认知框架；商法解释是商法思维的媒介工具，是大前提和 小前提连接过程中的重要手段；司法三段论是商法思维对商事案件进行裁判的基本逻辑推 理工具。商法思维的特殊性在于，商法的理念、价值和原则引导商法思维的运行并渗透在商 法思维适用的各个环节中。从商法解释方法和商法思维模式的应用，到商法三段论的逻辑 推理，乃至在商法的利益衡量和价值判断之中，商法理念、价值和原则像“无形之手”影响 着法官对商事法律事实的确认和对商事法律规范的理解与适用。

Abstract: The logical structure of commercial law thinking is a strict system composed of the idea, value and principle of commercial law, commercial law thinking mode, judicial syllogism and commercial law interpretation method. The idea, value and principle of commercial law are the logical core and starting point of commercial law thinking; thinking mode is the cognitive framework of commercial law thinking; commercial law interpretation is the media tool of commercial law thinking and an important means in the process of connecting major and minor premises; judicial syllogism is the basic logical reasoning tool of commercial law thinking to judge commercial cases. The particularity of commercial law thinking is that the idea, value and principle of commercial law guide the operation of commercial law thinking and permeate all aspects of its application. From the application of commercial law interpretation method and thinking mode to the logical reasoning of commercial law syllogism, and even in the interest measurement and value judgment of commercial law, the idea, value and principle of commercial law are like the‘invisible hand’that affect judges’confirmation of commercial legal facts and understanding and application of commercial legal norms.
