内容提要 《立法法》修改新增加的第 104 条,对司法解释的制定主体、启动因由、解释 对象、除外情形、解释标准和监督机制等问题作出规定,对司法解释权限重新做了界定。 《立 法法》第 104 条蕴含的价值目标主要有坚持和维护人民代表大会制度,确保司法公正,保障 审判独立和严守司法解释权限。 最高人民法院应以贯彻实施立法法为契机,依据《立法法》 第 104 条规定,提高司法解释工作的法治化程度。 在司法解释的诸形式中,对“规定”来说, 实体性的应予废除,程序性的可以保留;“批复”应逐步被指导性案例所替代;“解释”可以保 留,但其内容与体例都需改变。 全国人大常委会应明确《立法法》第 104 条与《关于加强法律 解释工作的决议》的关系,强化对司法解释的备案审查,加强法律解释,提高立法质量。

Abstract: The newly added article 104 in the Law of Legislation stipulates the subject for making judicial interpretations, causes, the object of judicial interpretation, exclusions, interpretation standards, supervisory mechanism of judicial interpretation, and redefines the limitation on judicial interpretation power. Article 104 implicates many value targets such as persevering in and maintaining the People’ s Congress System, guaranteeing the judicial justice, ensuring the independence of trial, and observing strictly the judicial interpretation limits. The Supreme People’ s Court shall take the opportunity of implementing the Law of Legislation to enhance the degree of legalizationin the work of judicial interpretation in the light of article 104 of the Law of Legislation. In various forms of judicial interpretation, substantive ones shall be abolished, while procedural ones shall be reserved in the aspect of “ provisions” ; “judicial reply” shall be replaced gradually by guiding cases; “interpretation” shall be reserved with its substance and modes being modified. NPS Standing Committee shall clarify the relationship between article 104 of the Law of Legislation and the Resolution on Strengthening the Legal Interpretations, intensify the case record review of judicial interpretation, improve legal interpretations and enhance the quality of legislation.
