内容提要 农民集体土地所有权的性质决定了管理权能是集体土地所有权的必要权 能，该管理权能包括集体成员的民主管理、民主监督和集体组织的执行管理和监督管理。 在涉及集体土地所有权的立法中，应当明确将管理权能规定为集体土地所有权的权能，并 从管理权能的内容、管理权能的行使等各个方面作出完善的规定，使集体土地所有权管理 权能的行使有法可依。

Abstract: The nature of collective land ownership of farmer determines that the management rights are essential rights for collective land ownership，the management rights comprise the democratic management and supervision of collective members，and collective organization’s management of execution and supervision． With respect to legislation involving collective land ownership，the management rights shall be explicitly stipulated to be rights of collective land ownership，and sound provisions shall be made for all aspects of the management rights，including the content and the exercise of the managing rights，so that there are laws to abide by when exercising the managing rights of collective land ownership．
