内容提要 《中共中央关于全面推进依法治国若干重大问题的决定》明确提出，加强 市场法律制度建设，编纂民法典。这一决定为我国民法典的编纂注入了强大动力。依中外 民事立法经验看，民法典编纂是推进并保障改革的强力工具。全面深化改革和全面推进依 法治国为民法典的编纂提供了千载难逢的良好机遇。在全面深化改革的历史背景下，民法 典的编纂必须处理好稳定性与开放性、自治与管制、继承与借鉴、守成与创新、一般法与特 别法等几种关系。同时，民法典编纂应当积极反映改革成果、引领改革发展。

Abstract: Decision of the CPC Central Committee on Major Issues Pertaining to Comprehensively Promoting the Ｒule of Law has stressed the construction of market law system and the compilation of civil code，which has add motivation to the compilation of Chinese civil code． According to the experience of worldwide civil legislation，the compilation of civil code is the important tool to promote the reform． Comprehensively deepening the reform and promoting the rule of law have provided opportunity for the civil code compilation． In the historical background of comprehensively deepening the reform，the civil code compilation should well deal with the relationships between stability and openness，autonomy and control， inheritance and learning，conservatism and innovation，general law and special law． At the same time，the compilation of civil code should reflect the achievement of reform and lead the reform development．
