内容提要 党的十八届四中全会把贯彻中国特色社会主义法治理论与坚持党的领导、 坚持中国特色社会主义制度共同作为中国特色社会主义法治道路的核心要义。中国特色 社会主义法治理论的科学定位可以从三个方面来把握: 第一，中国特色社会主义法治理论 是中国特色社会主义理论体系的重要组成部分; 第二，中国特色社会主义法治理论是人类 法治文明的最新成果、最高成就; 第三，中国特色社会主义法治理论是对中国法治实践的理 论表达。中国特色社会主义法治理论博大精深、内涵丰富，可以概括为社会主义民主制度 化、法律化、程序化的理论等十四个重大理论观点。随着中国特色社会主义法治建设事业 的纵深推进，法治理论体系的内涵还会不断丰富，但一些基本的东西必须长期坚持。

Abstract: The implementation of the legal theory of socialism with Chinese characteristics，and the insistence of the leadership of the Party and the socialist with Chinese characteristics are defined as the core of the rule of law in socialism with Chinese characteristics in the fourth plenary session of the 18th Communist Party of China ( CPC) Central Committee． The scientific orientation of the legal theory of socialism with Chinese characteristics can be explained from three aspects: first，the legal theory of socialism with Chinese characteristics is an important part in the theoretical system of socialism with Chinese characteristics; second，the legal theory of socialism with Chinese characteristics is the newest achievement of human legal civilization; third，the legal theory of socialism with Chinese characteristics is the theoretical expression of the practice of Chinese rule of law． The legal theory of socialism with Chinese characteristics can be summarized in fourteen theoretical conceptions including democracy systematization，legalization and routinization of socialism． With the promotion of socialist legal construction with Chinese characteristics，the connotation of legal theoretical system will be enriched，but some basic theories must be persisted．
