内容提要 目前，建立行政决策终身追责制存在着行政决策难界定、责任形式太繁杂、 责任主体难确定、责任认定标准不客观、追责主体不可信等法律难题。为此，我国行政决策 终身追责制度的法治建构应当规定并遵守“课责选择”的基本规则，将责任主体厘定为“行 政机关的领导干部”，建立并细化客观化的归责标准，构建多元、合作的追责体系，对“终 身”依据责任形式的不同作区别解释和适用。与之配套的是应该尽快建立多元、客观、科学 的行政决策结果评估体系; 尽快建立和完善主体多元、合作高效的追责主体体系; 拓宽行政 诉讼的受案范围，探索公民提起公益诉讼制度; 尽快出台《重大行政决策程序条例》。

Abstract: At present，the system construction of the life liability of executive decision exists difficulty in hard demarcation of executive decision，tedious liability pattern，the uncertainty of liability subject，subjective liability affirmation standard and the unreliable liability subject． Hence，the legal construction of the life liability system of executive decision should stipulate and obey the basic rule of accountability choice，confirm the liability subjects as the leading cadres of executive organs，build and refine the objective imputation standard， construct the diverse and cooperative liability system，and explain the difference in lifelong obeyed liability patterns． To match this，the diverse，objective and scientific executive decision result assessment needs to be built． The liability subject system with multiple subjects and effective cooperation should be established and improved as soon as possible． It needs to expand the scope of executive lawsuit，explore the system of citizens’public interest litigation，and release the Ｒegulation of Major Administrative Decision Procedure．
