内容提要 主任检察官制度,是指主任检察官与多名检察官组成的办案组在检察长及检委会领导下,对授权范围内的案件依法独立行使决定权并承担相应办案责任的制度。它是为了弥补当前检察活动和检察制度中的诸多不足与缺陷而开展的一项改革试点工作。经过近几年的探索,打破了原有的行政审批办案模式,建立了全新的办案组织和工作机制。该项制度的推行,需要实现检察管理的扁平化、集约化和专业化,需要从法律上形成主任检察官资格准入、管理监督、考核评价及执业保障机制。

Abstract:Direct prosecutor system refers to the system that under the leadership of chief prosecutor and procuratorial committee,the handling group composed of direct prosecutor and several prosecutors,independently exercises the power of decision in accordance with law concerning the cases within the scope of authorization and assumes its liability accordingly. It is a pilot reform carried out to make up the insufficiency and defects of current procuratorial practice and system. Through recent years' exploration,it breaks the original working mode of administrative examination and approval, and establishes brand-new organization and working mechanism. The implementation of this institution requires the realization of flattening,intensive and professional procuratorial management,requires the legal formation of professional qualification mechanism,managerial supervision mechanism,examination and evaluation mechanism and professional safeguard mechanism.
