内容提要 检察机关办案,时采"协同办案"乃至团队协作形式,但以单独办案制为基本,检察官办案责任制即"承办负责制"。因此不应以主任检察官责任制代替检察官责任制,同时,应当划清权限范围,保障承办负责制的有效运行。员额制的实施,可能压缩主任检察官制度的运行空间。主任检察官与业务部门负责人的设置与职能区分,应尽可能合一。不能合一时,部门负责人重点负责宏观指导,主任检察官主要负责个案审核。捕、诉合一虽有利于提高效率,但使批捕不中立弊端更为明显。检察官责任制应与检察长负责制相协调,实现合理授权。应建立权力清单,检察权运行机制的设置和管理应当细化与科学化。

Abstract: When procuratorial organs handle cases, “Collaborative working ” even teamwork cooperation form is sometimes adopted,with independent handle system being the basic. The responsibility system of prosecutor is “responsibility undertaken system ”.Therefore,it cannot be replaced by direct prosecutor system. In the meantime,it should make a clear distinction between them in order to guarantee the effective operation of responsibility undertaken system. The implementation of the system of specified personnel may reduce the operation space of direct prosecutor system. The set and functional distribution of the direct prosecutor and the department leader should be syncretic,if possible. When syncretism cannot be reached,the department leader shall be mainly responsible for macro guide while the direct prosecutor for case review. Although the syncretism of arrest and appeal is in favor of increasing efficiency,it makes the disadvantage of the unneutral position of arrest approval clearer. Responsibility system of prosecutor shall be in line with responsibility system of chief prosecutor to realize proper authorization. Power checklist shall also be established to make the set and management of the operating mechanism of procuratorial power refined and scientific.
