内容提要 电子证据痕迹区别于传统证据痕迹,其以独特作用机理在事实认定方面发挥重要作用。电子证据痕迹效应是指数据信息基于自身的数字化与虚拟化特征,在数字空间中产生、变动和运用的整个生命流程中,均会留下可追溯的痕迹,这些痕迹构成了多维度的证据网络。其核心要素主要呈现为两个面向,即属性契合性和功能基础性。电子证据痕迹具有可追溯性、可分离性、可印证性、可修复性等属性,为虚拟空间和物理空间的案件事实重现提供了重要分析要素。通过电子证据痕迹效应理论的建构和运用,依据数据信息在生成、传输、存储、提取、修改和销毁过程留下的可追踪的痕迹,能够为解决电子证据在取证、举证、质证和认证活动中面临的难题提供一个统括性的规范原理。电子证据痕迹效应理论运用能够辐射到数据类证据的综合审查认定层面,助力数据类证据审查规范建构思路的转型,优化阶梯式数据类证据分类审查机制,构建数据类证据收集审查中的信息痕迹权利保护体系。

Abstract: Electronic evidence traces differ fundamentally from traditional evidence traces, playing a crucial role in fact determination through distinctive operational mechanisms. The theory of electronic evidence trace effect posits that data information, based on its inherent digital and virtual characteristics, leaves traceable imprints throughout its entire lifecycle, including creation, modification, and utilization within digital spaces. These traces form multi-dimensional evidence networks. The core elements primarily manifest in two dimensions: attribute compatibility and functional foundational elements. Electronic evidence traces possess attributes of traceability, separability, verifiability, and recoverability, providing essential analytical elements for reconstructing case facts in both virtual and physical spaces. Through the construction and application of the electronic evidence trace effect theory, a comprehensive regulatory principle can be established based on trackable traces left during data information generation, transmission, storage, extraction, modification, and deletion processes. This addresses challenges in electronic evidence collection, presentation, cross-examination, and authentication. Simultaneously, the electronic evidence trace effect theory extends to the comprehensive review and determination of data-type evidence, facilitating the transformation of review standard construction approaches, optimizing hierarchical data-type evidence classification and review mechanisms, and establishing information trace rights protection systems in data-type evidence collection and review processes.
