内容提要 我国环境法的体系化工作在推进中国特色社会主义法治体系和构建现代环境治理体系两条主线的合力下，形成了鲜明的实用主义体系化范式。在生态文明建设的新阶段，这一范式面临规范冲突、功能协调不足、价值秩序不稳定等挑战，需要面向生态文明建设任务，立足规范体系、秩序体系和意义体系三个维度向融合主义范式转变。融合主义范式的本质，是通过类型化、层次化的技术将多元生态环境规范统合起来，塑造有关生态文明的观念秩序和制度秩序，发掘并释放契合生态文明的新意义体系。为了进一步推进环境法体系化，一方面，要通过重构概念、重述原则、重塑制度完成要素的改造与升级；另一方面，要以行为和风险规制机制、协调发展机制、利害调整机制为着力点来完善法律调整机制。当前，应当抓住生态环境法典编纂的历史机遇，激活环境法的体系效用。

Abstract: The systematization of environmental law in China mainly unfolds along two key lines: promoting the rule of law with Chinese characteristics and constructing a modern environmental governance system, forming a pragmatism systematic paradigm. In the new stage of ecological civilization construction, this paradigm faces challenges such as normative conflicts, insufficient functional coordination, and unstable value orders. Therefore, it is necessary to face the task of ecological civilization construction and shift towards a syncretism paradigm based on the three dimensions of normative system, order system and meaning system. The essence of the syncretism paradigm is to systematically integrate diverse ecological and environmental norms through typification and hierarchical techniques, shaping the order of concepts and institutions related to ecological civilization while exploring and unleashing new meanings that align with ecological civilization. To further promote the systematization of environmental law, efforts should be made on one hand to reconstruct concepts, restate principles, and reshape institutions to complete the transformation and upgrading of elements, and on the other hand to improve legal adjustment mechanisms by focusing on behavioral and risk regulation mechanisms, coordinated development mechanisms, and interest adjustment mechanisms. Currently, seizing the historical opportunity of compiling the Ecological Environment Code is essential to activate the utility of environmental law systematization.
