内容提要 行政复议作为化解行政争议的主渠道目标定位的法定化是新修订的《行政复议法》的一大亮点。主渠道目标意味着行政复议具有行政司法的属性，行政复议之化解争议、行政监督与行政救济的多元功能由此得以重塑。主渠道目标涉及行政争议化解格局调整，对行政复议与行政诉讼衔接关系提出了新的要求。行政复议与行政诉讼在差异化定位基础上的协同共进，以及行政诉讼对行政复议监督模式的回应性发展，应成为主渠道目标导向下两者实现衔接耦合的基本路径。基于行政解纷的整体主义系统观，行政复议与行政诉讼应分工科学、互补互洽、相互配合制约，以彰显中国特色行政争议化解法治体系的独特优势和强大生命力。

Abstract: A highlight of the newly revised Administrative Reconsideration Law is legalizing administrative reconsideration as the goal of the main channel for resolving administrative disputes. The goal of the main channel for resolving administrative disputes implies that the attribute of administrative reconsideration is administrative justice, thereby reshaping the multiple functions of dispute resolution, administrative supervision and administrative relief in administrative reconsideration. The goal of the main channel for resolving administrative disputes drives the transformation of the pattern of administrative dispute resolution, which puts forward new requirements for the better connection between administrative reconsideration and administrative litigation. The synergistic progress based on the differentiated positioning of administrative reconsideration and administrative litigation, as well as the responsive development of administrative litigation to the supervision mode of administrative reconsideration, will become the basic way to realize the articulation and coupling of the two under the goal-oriented main channel. Based on the holistic system view of administrative dispute resolution, administrative reconsideration and administrative litigation should promote scientific division of labor, be mutually complementary and beneficial, and coordinate and constrain each other, so as to highlight the unique advantages and strong vitality of the rule of law system of administrative dispute resolution with Chinese characteristics.
