The enactment of the Energy Law addresses a legislative gap in China’s energy framework, aiming to enhance national energy security and establish a legal foundation for a green and low-carbon transition. This paper traces the phases of China’s energy lawmaking process, explores the legislative drivers and key provisions, and examines the outstanding challenges in the application of the Energy Law. While the Energy Law represents a significant step, challenges remain, including the need for better coordination of government functions, deeper market-oriented reforms, and more effective green and low-carbon policies. The Energy Law remains an initial step toward a fully developed energy governance system.
内容提要 《能源法》的颁布填补了中国能源法律框架的立法空白，旨在提升国家能源安全水平，并为绿色低碳转型奠定法律基础。本文回顾了中国能源立法的历程，探讨了立法推动因素及主要条款，并分析了《能源法》在实施过程中仍存在的突出挑战。尽管《能源法》是重要的一步，但仍面临诸多挑战，包括政府职能协调的改进需求、市场化改革的深化以及绿色低碳政策的有效落实。
