内容提要 中国式现代化是物质文明和精神文明相协调的现代化。精神文明建设关涉保护文化权利、提升社会文明程度和促进人的全面发展，需要以文化法治建设为支撑。建设文化法治体系是贯彻落实习近平文化思想和习近平法治思想的必然要求，是促进社会主义先进文化繁荣发展的重要保障，是强化国民身份认同的重要途径。文化法治体系具有三重法理内涵，即新时代文化法治建设的总抓手、中国特色社会主义文化制度的法律表现形式和文化法治运行实践的系统集成。在法治轨道上推进文化强国建设，必须深入贯彻落实党的二十届三中全会关于深化文化体制机制改革的部署，从意识形态、文化服务、文化产业、文化遗产、网络治理和文化传播等关键领域的法治建设入手，加快构建文化法治体系，破解制约文化发展的深层次问题，开创文化繁荣发展新局面。

Abstract: Chinese modernization is a modernization that coordinates material civilization and spiritual civilization. The construction of spiritual civilization is related to the protection of cultural rights, the enhancement of social civilization and the promotion of all-round human development, and needs to be supported by the construction of cultural rule of law. The construction of China’s cultural rule of law system is an inevitable requirement for implementing Xi Jinping Thought on Culture and Xi Jinping Thought on the Rule of Law, an important guarantee for promoting the prosperity and development of socialist advanced culture and an important way for strengthening identity recognition. This system holds significant theoretical and practical importance. The cultural rule of law system in China has three connotations: it is the overarching approach to the construction of cultural rule of law in the new era; it is the legal manifestation of the system of socialist culture with Chinese characteristics; and it is a systematic integration of the practical operation of the cultural rule of law. To develop a strong socialist culture in China under the rule of law, it is imperative to thoroughly implement arrangements of the Third Plenary Session of the 20th Central Committee of the Communist Party of China on deepening cultural system and mechanism reforms. Starting with the rule of law construction in key areas such as ideology, cultural services, cultural industries, cultural heritage, cyber governance, and cultural transmission, we should accelerate the construction of the cultural rule of law system, solve the deep-rooted issues hindering cultural development and create a new situation for the prosperity and development of culture.
